This is an agreement between you or the entity you represent (hereinafter “You” or “Your”) AND Desygner Pty Ltd having an address at Level 6/64 Ferny Avenue, Surfers Paradise, Gold Coast, QLD 4217, Australia governing your use of all our iOS and Android mobile applications AND Desygner Pte Ltd having an address at 68 Circular Rd, #02-01, 049422, Singapore governing Your use of our websites, products and content at knowz.com, desygner.com and webrand.com as well as our regional domains as may be utilised by us at anytime AND The Terms of Service of the We Brand website provides that the Australian Company (Desygner Pty Ltd) is the Data Controller for our iOS and Android mobile applications for the purposes of the GDPR, and that the Singaporean Company (Desygner Pte Ltd) is the Data Controller for Your use of our websites, products and content at knowz.com, desygner.com and webrand.com as well as our regional domains as may be utilised by us at anytime, for the purposes of the GDPR.

Interpretation and Definitions

Interpretation

The words with capitalized initial letters have meanings defined under the following conditions. These definitions shall have the same meaning regardless of whether they appear in singular or plural.

For the purposes of this Privacy Policy:
  • Account: A unique account created for You to access our Service or parts of our Service.
  • Affiliate: An entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.
  • Application: Refers to We Brand and Desygner, the software program provided by the Company.

  • Company (referred to as either "the Company," "We," "Us," or "Our" in this Agreement): Refers to Desygner Pty Ltd, Level 6/64 Ferny Ave, Surfers Paradise QLD 4217 and Desygner Pte Ltd, 68 Circular Rd, #02-01, 049422, Singapore. For the purpose of the GDPR, the Company is the Data Controller.
  • Consumer: For the purposes of the CCPA/CPRA, a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual domiciled in the USA who is outside the USA for a temporary or transitory purpose.
  • Cookies: Small files placed on Your computer, mobile device, or any other device by a website, containing details of Your browsing history on that website among other uses.
  • Country: Refers to Queensland, Australia (Desygner Pty Ltd) and Singapore (Desygner Pte Ltd).
  • Data Controller: For the purposes of GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of processing Personal Data.
  • Device: Any device that can access the Service, such as a computer, cellphone, or digital tablet.
  • Do Not Track (DNT): A concept promoted by US regulatory authorities, particularly the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control tracking of their online activities across websites.
  • Facebook Fan Page: A public profile named the hub specifically created by the Company on the Facebook social network, accessible from the hub.
  • GDPR: Refers to the EU General Data Protection Regulation.
  • Organization: A legal entity or a group of individuals acting as a single entity, such as a company, government agency, or non-profit organization, that uses our Application or internet-provided tools. The organization may be required to provide certain information, such as user data, to use the Application's services.
  • Personal Data: Any information that relates to an identified or identifiable individual.
    • For GDPR: Any information relating to You, such as a name, identification number, location data, online identifier, or other factors specific to physical, physiological, genetic, mental, economic, cultural, or social identity.
    • For CCPA/CPRA: Any information that identifies, relates to, describes, or can reasonably be linked, directly or indirectly, with You.
  • Service: Refers to the Application or the Website or both.
  • Service Provider: Any natural or legal person who processes data on behalf of the Company, such as third-party companies or individuals employed by the Company to facilitate the Service, provide the Service, perform related services, or assist the Company in analyzing the Service’s usage. Under GDPR, Service Providers are considered Data Processors.
  • Third-party Social Media Service: Refers to any website or social network website through which a User can log in or create an account to use the Service.
  • Usage Data: Data collected automatically, generated by the use of the Service or from the Service infrastructure itself (e.g., the duration of a page visit).

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:

  • Personal Design Assets: When you create content using our Services, you may choose to upload images, icons, fonts, videos, files, as well as add textual content.
  • Business Information: Our Services can be used for business purposes. If you are authorized to create or manage an account on behalf of an organisation, you may choose to provide information related to that organisation.
  • Business Brand Assets: When you manage or create content for an organisation, you may choose to upload logos, images, icons, fonts, videos, files, as well as add textual content on behalf of that organisation.
  • Information you provide through our support channels: Our Services provide customer support channels, where you may choose to submit information regarding a problem you are experiencing. Whether you email us, open a support ticket, speak to one of our representatives directly or otherwise engage with our support team, you will be asked to provide contact information, a description of the problem you are experiencing, screenshots, or information that would be helpful in resolving the issue.
  • Payment Information: In case of services requiring payment, we request credit card or other payment account information, which will be used solely for processing payments. Your financial information will not be stored by us except for the name of the card holder, the expiry date, and the last four digits of the Credit Card number. Subject to your prior consent and where necessary for processing future payments, your financial information will be stored in encrypted form on secure servers of our reputed payment gateway service provider who is beholden to treating your personal information in accordance to the General Data Protection Regulation (GDPR) (EU) 2016/679 and this Privacy Policy Statement.
We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company’s servers and/or a Service Provider’s server or it may be simply stored on Your device. Facebook Fan Page

Data Controller for the Facebook Fan Page

The Company is the Data Controller of Your Personal Data collected while using the Service. As the operator of the Facebook Fan Page, the Company and the operator of the social network Facebook are Joint Controllers. Facebook Insights

We use the Facebook Insights function in connection with the operation of the Facebook Fan Page and on the basis of the GDPR to obtain anonymized statistical data about Our users.
